Anatomy of a Texas Pay Stub

The fields that matter, and what to check on each one.

Employer and employee details
Company name, employee name, and ID. Texas law lets FLSA-covered employers follow federal recordkeeping instead of a state stub rule, but the basics belong on any stub.
Pay period and pay date
Texas requires most non-exempt employees to be paid at least twice a month, so expect semimonthly, biweekly, or weekly periods.
Earnings
Regular and overtime hours and rates. Texas follows the federal $7.25 minimum wage and 40-hour overtime rule.
Federal taxes
Federal income tax, Social Security, and Medicare. No Texas state income tax line.
Deductions
Benefits, retirement, and any court-ordered withholdings, each labeled.
Net pay and year-to-date
Take-home pay and running totals for the calendar year.

Texas Pay Stub FAQs

No. The Texas Constitution prohibits a personal state income tax. Only federal income tax, Social Security (6.2%), and Medicare (1.45%) are withheld from employee paychecks in Texas.

Texas Labor Code Section 62.003 requires an earnings statement each pay period, on paper or electronically, from employers covered by the Texas Minimum Wage Act. That Act does not apply to employers already covered by the federal FLSA, so most larger Texas employers have no state stub mandate, though nearly all provide one.

Both states have no personal income tax, so the tax deductions are identical (federal only). The difference is in compliance: Texas requires an earnings statement under Labor Code 62.003 for employers outside the federal FLSA, while Florida has no general pay stub law beyond day labor and farm labor rules.

A Texas paystub is among the simplest in the country because the Texas Constitution prohibits a personal income tax. Only federal income tax, Social Security (6.2%), and Medicare (1.45%) are withheld from employee wages.

Texas has light pay stub rules: Section 62.003 of the Texas Labor Code requires an earnings statement only from employers outside the federal FLSA. Even so, detailed paystubs are a best practice for proof of income, tax filing, loan applications, and dispute resolution.

Federal Income Tax • Social Security (6.2%) • Medicare (1.45%) • Gross and net pay • Pay period dates • Employer and employee information

Texas constitutionally prohibits a personal state income tax, so no state tax line needed. • Texas Labor Code Section 62.003 requires an earnings statement each pay period, but only from employers not already covered by the federal FLSA. • Non-exempt employees in Texas must be paid at least semi-monthly. • Consider including YTD totals for loan applications and tax preparation even though they are not required.
